THE FOLLOWING DESCRIBES THE TERMS AND CONDITIONS UNDER WHICH CHINESE ARTWORKS INC. (CART) OFERS EACH USER ("USER" OR "YOU") ACCESS TO ITS SERVICES. BY USING THE CART) WEB SITE, YOU AGREE TO, AND ACKNOWLEDGE YOU ARE BOUND BY, THE TERMS AND CONDITIONS BELOW.

1. User acknowledgments:

a. Works of art ("Property") advertised or displayed on the CART web site may not be available. All Property on the CART web site is subject to availability.

b. CART may, without notice, change these terms and conditions, including, without limitation, terms affecting price, availability, information and site access.

Your continued use of the CART web site after any such changes will be considered acceptance of those changes.

c. Some of the information featured on the CART web site may contain incomplete data, typographical errors or inaccuracies. Any errors are wholly unintentional. CART cannot be responsible if erroneous information is reflected in the price of Property, in the availability of Property or affects the purchase of Property in any way, and you acknowledge that CAG expressly disclaims any liability arising from the posting of erroneous information. You acknowledge that CART presents its content "as is" and makes no claims to its accuracy, either expressed or implied. CART reserves the right to amend errors or to update Property or product information at any time without prior notice.

d. CART reserves the right to terminate, change, suspend or discontinue any aspect of the web site, including but not limited to, content, features, design, or hours, without prior notice and without liability.

e. CART has made every effort to display the Property as accurately as possible. However, the photographs of Property displayed on the web site may have been subject to less than ideal conditions for proper photography of the Property. The formatting and photographs used, as well as the display and the color capabilities of your particular computer monitor may have affected the images on the CART web site. CART cannot be held responsible for the limitations of any monitor and does not guarantee that a monitor's display of any color, condition or detail of Property will be accurate.

2. Conditions of sale.

As to each item of Property you purchase:

a. No Property will be shipped unless the purchase price and any applicable taxes, as described below, have first been paid and the payment received by CART.

b. You shall pay CART the purchase price by means of check, money order or wire transfer;

c. You will pay all taxes, tariffs, duties and fees, including but not limited to any sales or use taxes, VAT, TVA, GST or other applicable transactional taxes or customs duties that may be due on sales arising from use of CART's web site or from purchasing Property;

d) You will be responsible for obtaining any relevant export or import licenses.

a. Within ten days of receipt by CART of the purchase price and all applicable taxes, CART will ship the Property to a destination specified by you. You will pay all such shipping costs, including crating, packaging, freight and shipping charges, and freight insurance. CART shall separately invoice these charges to you.

If within ten days following receipt by you of the purchased Property, CART receives written notice that you are dissatisfied with the Property and are returning the same, and CART receives the Property in the same condition as when you received it, CART will reimburse you for the purchase price. You will pay all shipping costs associated with such returns.

3. Disclaimers.

IT IS AGREED THAT CART HAS MADE NO AFFIRMATION OF FACT OR PROMISE RELATING TO THE PROPERTY BEING SOLD THAT HAS BECOME PART OF THE BASIS OF THIS AGREEMENT AND THE TRANSACTIONS CONTEMPLATED HEREBY. ALL PROPERTY IS CONVEYED "AS IS" AND "WITH ALL FAULTS." CAG HAS NOT MADE ANY EXPRESS OR IMPLIED WARRANTY OR REPRESENTATION OF ANY NATURE RELATING TO THE PROPERTY, THE WEB SITE AND ADVERTISEMENTS. CAG HAS NOT MADE AND DOES NOT MAKE, AND YOU ACKNOWLEDGE THAT CAG EXPRESSLY DISCLAIMS, ANY REPRESENTATION, COVENANT OR WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO THE CONDITION, DESCRIPTION, DIMENSIONS, AUTHENTICITY, ATTRIBUTION, PROVENANCE, MERCHANTABILITY, QUALITY OR FITNESS FOR ANY PARTICULAR PURPOSE WHATSOEVER OF THE PROPERTY. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE DESCRIPTION ON THE FACE OF THESE TERMS AND CONDITIONS.

TO THE BEST OF CAG'S KNOWLEDGE, THE INFORMATION AVAILABLE ON THE CAG WEB SITE IS CORRECT. HOWEVER, CAG DOES NOT REPRESENT, WARRANT OR GUARANTEE THE ACCURACY, COMPLETENESS OR CURRENCY OF SUCH INFORMATION NOR IS IT RESPONSIBLE FOR ANY ERRORS OR OMISSIONS THEREIN.

4. Limitation of Liability.

IN NO EVENT SHALL CAG BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES WHATSOEVER, RESULTING FROM ANY CLAIMS WHATSOEVER (INCLUDING, WITHOUT LIMITATION, FROM PRODUCT DISPARAGEMENT, DEFAMATION OR NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH YOUR PURCHASE OR USE OF THE PROPERTY OR USE OF THIS WEB SITE.
